Partner terms

These Partner Terms apply, in addition to the Terms of Use and Privacy Policy, to every doctor, clinic, chemist, laboratory and rider ("Partner") who joins For U. They are accepted when you complete onboarding and may be supplemented by a signed partner agreement, which prevails if there is a conflict. ForU Healthtech Private Limited provides technology only; each Partner is an independent professional or business, solely responsible for its services and for its compliance with the law.

1. Common terms for all Partners

Verification first: you will be listed and able to transact only after we verify your registration or licence. You must keep every registration, licence and accreditation valid and tell us within 24 hours if it is suspended, cancelled, restricted or expires. We re-verify periodically and may suspend you automatically on expiry or if a check fails.
No commission chain: no payment, discount, gift or benefit of any kind may pass between doctors and chemists, laboratories or other Partners for referrals, prescriptions or tests, through For U or outside it. For U does not pay or accept any such payment and will terminate any Partner who offers or accepts one.
No paid ranking, ratings or testimonials: you cannot buy visibility, and you must not solicit or publish reviews or testimonials about your services on For U.
Data protection: you will process patient data only to provide care or fulfil the order, keep it confidential, follow the access, consent and logging rules built into For U, never download, copy or use it for marketing, and report any suspected breach to us immediately. You will comply with the DPDP Act, 2023 and its Rules.
Independent status: nothing creates employment, partnership, agency or joint venture between you and For U. You are responsible for your own taxes, licences, staff, premises and insurance.
Indemnity: you will indemnify For U against claims, penalties and losses arising from your services, your negligence, your breach of these terms or of any law, and your staff's acts.
Suspension and termination: we may suspend or terminate your access with reasons, immediately where patient safety, a legal requirement, fraud or a serious breach is involved, and otherwise with 15 days' notice. You may leave with 30 days' notice. Obligations about records, confidentiality, settlement and indemnity survive.
Liability: For U's total liability to a Partner is limited to the platform fees or subscription paid by that Partner in the three months before the claim, and For U is not liable for indirect or consequential loss, to the extent permitted by law.
Disputes between For U and a Partner are resolved by arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by mutual agreement or, failing agreement within 30 days, under section 11 of that Act, seated at Gautam Buddh Nagar (Greater Noida), Uttar Pradesh, in English. Courts at that seat have exclusive jurisdiction for interim relief.

2. Doctors and clinics

You must hold a valid registration with the National Medical Commission or a State Medical Council and comply with the NMC Registered Medical Practitioner (Professional Conduct) Regulations, 2023, the Telemedicine Practice Guidelines, 2020 and all laws on prescribing.
Clinical decisions, prescriptions and records are your sole professional responsibility. For U's safety checks are aids only. You will not rely on For U to diagnose or dose.
You may sign prescriptions only after verification. You must print the molecule and strength beside every brand, must not prescribe restricted drugs by teleconsultation, and must write only what is clinically indicated.
Your profile shows factual information only. You must not advertise, solicit patients, or allow testimonials, in line with NMC regulations.
Assistants and staff you add act under your responsibility and see only what their role allows. You must remove staff access immediately when they leave.
Subscription: free during the pilot for its stated period; after that, the flat monthly fee published at the time, plus GST, paid by UPI AutoPay. If payment fails, your account becomes read-only after a grace period; your patients' records are never locked or held back.

3. Chemists

You must hold valid retail drug licences (Form 20/21 or as applicable) for the premises, employ a registered pharmacist who verifies every prescription, and comply with the Drugs and Cosmetics Act, 1940 and Rules, including Schedule H, H1 and X requirements and registers.
You are the seller of record. You issue the GST invoice in your own name and are solely responsible for the quality, authenticity, storage (including cold chain), expiry, labelling and dispensing of every item you supply.
No substitution: you must supply only the exact brand, strength and quantity prescribed. If you cannot, you must mark the item unavailable before dispatch; you must never substitute.
You must confirm or decline an order within the acceptance window. The price you accept is locked and must never exceed the MRP. You must not supply narcotic, psychotropic or other drugs restricted from online sale.
At dispatch you must scan items, record batch and expiry, seal the bag, record the seal ID and take a pack photo. These records decide claims.
Fees and settlement: For U charges a platform fee of 2% to 3% of the taxable value of orders you fulfil (as agreed at onboarding), plus 18% GST. The payment aggregator settles your share after a short hold, net of the platform fee, GST on it, TCS and TDS deducted as required by law, and any upheld claims or chargebacks. You receive per-order statements and monthly tax summaries.
Your licence expiry is tracked; you will receive reminders, and your listing is suspended automatically on expiry until a valid licence is verified.

4. Laboratories

You must hold current NABL accreditation and offer through For U only tests within your accredited scope, hold registration under the Clinical Establishments Act or state law where applicable, have a registered pathologist sign every report, and hold a valid biomedical waste authorisation.
You are solely responsible for collection, transport, testing and reporting, and for your collectors, who must be qualified, verified and identifiable.
You must report critical values to the ordering doctor at once, never hold them back, and follow For U's rules for sensitive and HIV results. HIV tests require the patient's recorded consent before booking.
Samples spoiled in collection or transport are re-collected at your cost. Platform fees are as agreed at onboarding, plus GST, settled in the same way as for chemists.

5. Riders

You are an independent platform worker, not an employee of For U, a chemist or a patient. You choose when to go online and which offers to accept; declining an offer never counts against you.
You must hold a valid driving licence and vehicle documents, follow traffic laws, never ride unsafely to save time, and register on the e-Shram portal. For U registers as an aggregator and makes the social security contributions required under the Code on Social Security, 2020.
You carry only sealed bags, never open them, hand over only against the patient's one-time code with a photo, and keep patient details confidential.
You see the fare before accepting and are paid daily to your bank account. Deactivation happens only with reasons and notice, except for serious safety or fraud concerns, and you may ask for a review.
